| For Hawe's girls: Freedom, Order, Equality Explain where you placed yourself on the four quadrant graph we completed and discussed in class. In placing yourself, why did you give the weights you did to the themes of freedom, order, and equality. Does your political “label” according to the graph accurately reflect your positions on today’s political issues? Write your own "verdict" on the case of Morse v. Frederick which we discussed in class. In your verdict, indicate whether -- and why -- you agree or disagree with the decision of the US Supreme Court, which held that Morse was justified in suspending Frederick from school for displaying the banner "Bong Hits 4 Jesus" and that Frederick's actions were not protected by the free speech clause of the First Amendment. Your verdict should also deal with the three precedential cases in the area of free speech and public schools which are cited in the sheet on the mini-debate, namely Hazelwood v. Kuhlmeier, on the control of newspapers in schools; Bethel v. Fraser, on the control of profanity, and Tinker v. DesMoines, on the expression of political views; i.e. if you believe that one or more of these cases supports your position, you want to explain why; conversely, if you believe that one or more opposes your position, you want to explain why that case should not be seen as a determining factor in this case. Finally, go on-line and find a site discussing the case (a Google search of "Morse v. Frederick" will turn hundreds of hits), name the site you read, and note whether any of the arguments advanced by the actual Supreme Court justices on either side of the issue were surprising to you or might have changed your view of the case. | |
